Comunicado firmado por más de 130 organizaciones sociales y redes de asociaciones de Europa, EEUU y Latinoamérica frente a los ataques contra esta organización y sus miembros.

Las organizaciones abajo firmantes queremos reiterar nuestro respaldo a las y los defensores de derechos humanos de la Comisión Intereclesial de Justicia y Paz (CIJP), ante el incremento de agresiones que ponen en riesgo su vida y perjudican su labor legítima y esencial para la democracia y la paz en Colombia.

Durante los últimos tres meses, se han intensificado las difamaciones y los seguimientos contra los miembros de la CIJP y en especial Alberto Franco, Danilo Rueda y Abilio Peña. Los estudios de riesgo realizados por el gobierno colombiano calificaron de “riesgo extraordinario” la situación en la que se encuentran 18 de los miembros de la CIJP que trabajan en Bogotá, Putumayo, Meta, Valle, Cauca, Chocó y en la Costa Caribe. Mas recientemente, el 13 de febrero de 2013, el carro blindado en el que se moviliza el padre Alberto fue impactado en tres ocasiones en su vidrio panorámico con arma de fuego que se utilizó con silenciador, según informe preliminar de la SIJIN, mientras estaba aparcado frente a su residencia. El padre Franco había denunciado varios incidentes de vigilancia y seguimientos en su residencia durante todo el año 2012 y más recientemente los días 4, 11 y 13 de febrero de 2013.

Consideramos que estas amenazas son consecuencia de la labor que realiza la CIJP para la restitución de las tierras y el esclarecimiento de la responsabilidad estatal, de sectores militares y empresariales en robos de tierras, amenazas y violaciones de derechos humanos ante tribunales nacionales e internacionales. Estas intimidaciones ocurren pocos días después de que el Padre Franco informara en medios de comunicación como funcionarios del Gobierno del ex-presidente Alvaro Uribe han sido involucrados en el despojo y la ocupación ilegal de los territorios colectivos del Curvaradó y Jiguamiandó; y esta misma semana tuvo lugar la audiencia sobre el caso Marino López y otros de Cacarica ante la Corte Interamericana de Derechos Humanos.

Nosotros hemos observado cómo estas comunidades afrodescendientes, indígenas y campesinas que acompaña la CIJP son también atacadas por reclamar su derecho a la tierra. En diciembre de 2012 conocimos de primera mano en Curvaradó las denuncias sobre la presencia masiva de paramilitares uniformados y con armas largas, así como la amenaza de que van a perpetrar una masacre. En varias oportunidades hemos manifestado nuestra preocupación por los hostigamientos contra María Ligia Chavera y Enrique Petro, dos líderes emblemáticos del proceso de restitución de tierras de Curvaradó.

Esta semana hemos visto con profunda preocupación como los representantes del gobierno colombiano, en audiencia ante la Corte Interamericana de Derechos Humanos, deslegitiman los testimonios y atemorizan con un trato agresivo a las víctimas del desplazamiento masivo causado por la Operación “Génesis” en Cacarica en 1997. Estas acciones exponen los testigos y las víctimas a represalias y una vez más les revictimizan. Sabemos también de la intensificación de la campaña de difamación llevada a cabo por personas cercanas a los sectores empresariales que se aprovecharon del despojo, en contra de Liliana Ávila y de Danilo Rueda, representantes de CAVIDA Cacarica ante la Corte Interamericana, que alegan que manipularon a las víctimas para declarar contra militares y paramilitares. En este caso la justicia colombiana sentenció como responsable de la muerte del campesino Marino López, en desarrollo de la operación «Génesis», al general (r) Rito Alejo del Río, Comandante de la Brigada 17 del ejército nacional entre 1996 y 1997.

Las organizaciones firmantes conocemos las personas y las historias de las comunidades de Cacarica asociadas en CAVIDA, de Curvaradó y Jiguiamiandó que reclaman sus tierras. Les hemos apoyado en sus apuestas para un retorno digno y en condiciones de seguridad en su territorio. En una muestra de su compromiso por la paz, estas comunidades se han movilizado para presentar a su gobierno iniciativas de vida productiva y no-violenta en el marco del diálogo que se esta desarrollando con la guerrilla de las FARC-EP.

Por todo lo anterior, solicitamos al Gobierno colombiano:

1. Redoblar esfuerzos para garantizar la protección de las y los defensores de derechos humanos de la CIJP, y en particular realizar los estudios de evaluación de riesgo cuando haga falta e implementar los esquemas de protección requeridos desde abril de 2012, con especial atención a sus lugares de residencia;

2. Garantizar la seguridad para las personas que lideran la restitución de las tierras despojadas, como es el caso de Maria Ligía Chaverra y Enrique Petro en el Curvaradó y Jiguamiandó así como de otras / otros líderes amenazados;

3. Garantizar la seguridad para los testigos que buscan la verdad, justicia y reparación, como es el caso de los representantes de CAVIDA entre ellos Bernardo Vivas, Sofía Roa y Rosalba Córdoba

4. Avanzar decididamente en la lucha en contra de las causas estructurales de los ataques contra las y los defensores de derechos humanos como son la impunidad y la continúa existencia de grupos paramilitares;

5. Realizar investigaciones para identificar y sancionar tanto a los autores materiales como los intelectuales detrás de todas las amenazas y los hostigamientos contra las y los defensores de derechos humanos y en especial el reciente ataque en contra del padre Franco de CIJP y las informaciones calumniosas en contra de Liliana Avila y Danilo Rueda

Solicitamos a la Unión Europea, sus Estados miembros, Suiza y Noruega:

1. En el marco de las directrices de la Unión Europea para personas defensoras de Derechos Humanos hacer todo lo posible para visibilizar el apoyo internacional a la organización CIJP así como a los y las líderes de la restitución de las tierras despojadas.

2. En sus diálogos e interlocución con el gobierno Colombiano transmitir la preocupación por la protección de estas personas defensoras de Derechos Humanos; llevando las peticiones expresadas en este comunicado.

3. Realizar pronunciamientos públicos sobre la gravedad de la situación que viven las personas defensoras de derechos humanos pidiendo al gobierno Colombiano cumplir con su deber de protección.
