Por ello, nos dirigimos a ti para que nos ayudes a informar a los Diputados y Diputadas del impacto que tendría la puesta en marcha de este Real Decreto Ley y que tengan en cuenta dicha información a la hora de emitir su voto.
Lo que te proponemos es que leas nuestra propuesta y, si después de hacerlo estás de acuerdo con los contenidos de esta carta, te pedimos que rellenes los campos con tus datos y pulses el botón de enviar:
Estimado/a diputado/a
En el Pleno del próximo día 17 de mayo de 2012, está prevista dentro del orden del día, la votación del Real Decreto-Ley 16/2012 de “medidas urgentes para garantizar la sostenibilidad del Sistema Nacional de Salud y mejorar la calidad y seguridad de sus prestaciones.”
La aprobación y puesta en marcha de este Real Decreto Ley implica, además de modificaciones sustanciales de la legislación vigente, un cambio significativo en la concepción de la atención sanitaria que conocemos hasta la fecha y con la que estoy satisfecho. Asimismo, considero que una modificación de tal envergadura hubiese necesitado, además de una norma de rango superior, un debate previo abierto no sólo en el Parlamento, sino también con entidades profesionales y sociales que trabajan en este campo tan sensible.
Centrándonos en la norma, dentro del capítulo I, concretamente en su artículo primero, se establecen las condiciones para acceder al “derecho a la asistencia sanitaria en España”; unas condiciones que entrarán en vigor el 1 de Septiembre y que restringen ese derecho a múltiples colectivos como son:
Personas con nacionalidad, mayores de 26 años residentes en España que nunca han estado en situación de alta o asimilada al alta en el Sistema de Seguridad Social.
Personas con nacionalidad de alguno de los países miembros de la Unión Europea, del Espacio Económico Europeo o de Suiza que carezcan de certificado de residencia en España y/o no puedan acreditar su situación de paro involuntario.
Extranjeros nacionales de países terceros que carezcan de autorización de residencia en España.
Para éste último colectivo, cifrado en unas 150.000 personas, el Real Decreto prevé únicamente la atención sanitaria de urgencias (salvo en el caso de mujeres en proceso de gestación y los menores) como único supuesto de asistencia médica, volviendo a una concepción restrictiva que no aporta valor alguno a nuestra sociedad y que se erradicó en el año 2000 con la Ley Orgánica de Extranjería 4/2000.
Esta situación, supone el paso atrás mencionado y, en la práctica, además de un cambio en la concepción de Universalidad en el acceso a la salud pública, una vulneración del principio de equidad que guiaba hasta el momento las políticas de sanidad de este país. Esta situación puede provocar no sólo el colapso de las zonas de urgencia de los hospitales españoles, aumentando –paradójicamente- los costes en la atención sanitaria a la población, sino también dividir a la sociedad en ciudadanos de plenos derechos y no-ciudadanos” o ciudadanos sin derechos.
Asimismo, considero que la propuesta de la atención de estas personas a través de convenios entre las Comunidades Autónomas y ONG sigue vulnerando la vocación de universalidad de nuestro sistema sanitario y no haría sino ahondar en la brecha arriba señalada creando sistemas de atención sanitarias paralelos.
Por ello, le solicito, de cara a la votación para la ratificación del Real Decreto Ley 16/2012, como representante que es usted de la sociedad española en el Congreso, tenga en cuenta las siguientes peticiones:
Que vote en concordancia con sus creencias personales respecto a su concepción de la salud pública en España.
Que tenga en cuenta la importancia de dialogar y negociar públicamente en el Parlamento y con las entidades que desempeñan su trabajo en el área sanitaria o en la atención social, el alcance, impacto, viabilidad y alternativas de la modificación legislativa, antes de aprobar un cambio tan importante para nuestra sociedad.
Que tenga en cuenta las recomendaciones efectuadas por la Agencia de Derechos Fundamentales de la Unión Europea, que en su informe del pasado 11 de octubre de 2011, aconsejaba a los Estados miembros: “El acceso a la atención sanitaria necesaria debe facilitarse a los inmigrantes irregulares con arreglo a los mismos criterios que a los nacionales, aplicando idénticas normas en materia de pago de honorarios y exenciones”. De conformidad con el artículo 24 de la Convención sobre los Derechos del Niño (CDN) de las Naciones Unidas y con el artículo 12 de la Convención sobre la eliminación de todas las formas de discriminación contra la mujer, a las embarazadas deberá asistirles el derecho a una atención prenatal, durante el parto y postnatal gratuita y, a los niños, el derecho a una atención sanitaria prestada con arreglo a los mismos principios que a los nacionales, incluidas las vacunaciones.
Que tenga en cuenta a la hora de emitir su voto la opinión de entidades, además de las arriba firmantes (entre otras) como el Consejo General de la Abogacía, la Fundación Salud y Familia, Asociación de Amigos de las Naciones Unidas, la Red Comunitaria sobre VIH y sida del Estado español (REDVIH) la Asociación Galega de Medicina Familiar e Comunitaria, el Sindicato Médico de Asturias, la Red de Colegios Médicos, Médicos del Mundo o el Servicio Jesuita a Migrantes (SJM)-España.
