La prueba es que, antes de aplicar la nueva ley, Berlusconi y su ministro del Interior se han visto forzados a prever una regularización masiva de sin papeles, presionados por sus propios votantes y algunos de los dirigentes más destacados de la coalición. El Gobierno italiano se ha colocado, así, en una posición contradictoria, en la que se advierte la dimensión estrictamente propagandística de la iniciativa: considera que la inmigración ilegal es un comportamiento tan intolerable como para exigir una ley penal y, al mismo tiempo, tan corriente como para sobreseerlo antes de aplicársela.
También forma parte del arsenal del populismo la decisión de crear patrullas de voluntarios para combatir la inmigración ilegal u otros delitos, sean antiguos o de nueva creación. Velar por el cumplimiento de las leyes y por la seguridad de los ciudadanos son responsabilidades que los Estados de derecho no pueden delegar en nadie, y menos aún en un cuerpo de somatenes. Las tasas de criminalidad no experimentarán mejoras sustanciales por la colaboración de los voluntarios, pero, en cambio, la presencia de éstos en las calles italianas puede generalizar la sensación de que el país vive un clima de excepción. Precisamente el que más conviene a los proyectos populistas.
