A anunciada reforma da Lei de Estranxeiría contén algún precepto que penaliza valores éticos tan fundamentais en todas as culturas como a hospitalidade. Dentro da nosa comunidade O GRUPO DE APOIO ÁS PERSOAS EMIGRANTES (Gape) proponnos adherirnos ao seguinte manifesto.
MANIFIESTO PARA LA REFORMA DEL ART. 53 C) QUE SANCIONA A QUIENES AYUDEN SOLIDARIAMENTE A LAS PERSONAS EXTRANJERAS EN SITUACIÓN IRREGULAR.
“SALVEMOS LA HOSPITALIDAD”
“Todos los seres humanos nacen libres e iguales en dignidad y derechos y, dotados de razón y conciencia, tienen el deber de comportarse fraternalmente los unos con los otros” (art. 1 Declaración Universal de los Derechos Humanos).
Uno de los deberes presente en todas las culturas, y en algunas, seña de identidad, es el de la “hospitalidad”. Este deber ético, traducido incluso en forma de sanción cuando su omisión provoca riesgos para la integridad física del otro, está gravemente amenazado en España si prospera la anunciada reforma de la legislación de extranjería.
A la tendencia criminalizadora de la inmigración ilegal (considerar a la persona que quiere sobrevivir desplazándose por el planeta como un peligroso delincuente), se une ahora la de aplicar un marco sancionador a las personas que de manera solidaria ejercen el deber de la hospitalidad, colocando su comportamiento altruista como forma proscrita de”promoción de la permanencia ilegal en España”. Ello pone en automática situación de ilicitud a miles de personas que acompañan, hospedan en sus casas y apoyan a personas sin papeles. De este modo, ONG, Congregaciones religiosas y ciudadanos, que vienen ejerciendo el deber de acogida y la solidaridad para con las personas inmigrantes en situación de irregularidad administrativa, verían perseguida su actuación. Más aún: la reforma pretende ampararse en el silencio cómplice de los ciudadanos ante estos atropellos contra la dignidad humana y los derechos fundamentales.
En concreto, el art. 53 c) del Anteproyecto de modificación de la Ley de Extranjería sanciona como falta muy grave con la multa de 501 a 30.000 euros “a quien promueva la permanencia irregular en España de un extranjero. Se considera que se promueve la permanencia irregular cuando el extranjero dependa económicamente del infractor y se prolongue la estancia autorizada más allá del plazo legalmente previsto”.
Con el pretexto de proteger a los extranjeros sin papeles frente al abuso y las mafias, se incrementa exponencialmente su vulnerabilidad y se les priva de toda suerte de apoyo social solidario. Esta reforma legal tiene una enorme trascendencia ético-política: crea una norma que convierte en ilegal un principio-valor tan estructuralmente necesario en un Estado como es la solidaridad.
El objetivo de esta norma es intimidar a los ciudadanos españoles o extranjeros con papeles para que nieguen toda forma de apoyo a la persona en situación irregular y ésta se quede sin ningún tipo de ayuda, es decir, en la calle, sin comida, ni vestido, ni dinero, para que mediante la presión de esta situación de precariedad absoluta, vuelva a su país. Se olvida que “toda persona tiene derecho a salir de cualquier país, incluso del propio” (art. 13 Declaración Universal del Derechos Humanos) y que “en caso de persecución toda persona tiene derecho a buscar asilo y disfrutar de él, en cualquier país” (art. 14 DUDH).
Ante esta situación, exponemos:
1.- Que hemos constatado, después de tantos años acogiendo y acompañando itinerarios vitales de personas en situación de extrema vulnerabilidad personal y social, el valor de la solidaridad y la convivencia en nuestros domicilios como forma concreta de expresión de corresponsabilidad humana y social con aquellos que no tienen los mínimos de supervivencia –casa, pan y trabajo-.
2.- Que una parte significativa de la responsabilidad de la miseria en que se hallan los pueblos de origen de quienes tiene que migrar a España está provocada por procesos históricos y políticas económicas y colonizadoras (y descolonizadoras) de los Estados del denominado Primer Mundo, que mantiene intereses en el sostenimiento de regímenes no transparentes ni democráticos en el Tercero (incluida, por cierto, la venta de armas y el tráfico de personas).
3.- Que el principio de solidaridad para con los más desheredados del mundo es un elemento ético de legitimación en una sociedad que se denomina democrática, que considera que los bienes de la tierra tienen un destino universal y que ni la propiedad ni las fronteras pueden tener un valor absoluto ante la miseria del prójimo y su derecho a sobrevivir.
4.- Que el Estado español pierde toda legitimidad ético-jurídica cuando legisla contra el contenido esencial de los Derechos Humanos, despoja de todo tipo de ayuda material a las personas en situación irregular y pretende intimidar con graves sanciones a quienes ejerzan la hospitalidad y el cuidado del otro.
Ante ello, con independencia de otras numerosas discrepancias, proponemos al Gobierno, en este punto concreto, como auténtico mínimo ético, que modifique el Anteproyecto en el sentido de incorporar al texto normativo la necesidad de “ánimo de lucro”en el infractor para que pueda ser sancionable.
